Petition to Protect West Virginia Communities: Enact State-Level Criminal Penalties for Illegal Aliens
To the Members of West Virginia Legislature and Governor of West Virginia,
We, the undersigned citizens of West Virginia, are deeply concerned about the ongoing failure of the federal government to address the crisis of illegal immigration and the dangerous consequences it imposes on our communities. This failure has led to tragic consequences, including violent crimes committed by individuals who should not have been in our country in the first place.
In the past year alone, the Eastern Panhandle of West Virginia has witnessed the murder of a community member and an attempted rape and stabbing, both perpetrated by illegal aliens.
Nationally, over 38,000 convicted murderers and rapists reside unlawfully within our borders. This alarming trend demands immediate and decisive action to protect the safety and well-being of our citizens.
We, the people of West Virginia, demand the enactment of a state law that:
Classifies Illegal Presence as a Criminal Offense
Make the first offense of unlawful presence in the State of West Virginia a misdemeanor, punishable by immediate arrest and detention, with mandatory transfer to U.S. Immigration and Customs Enforcement (ICE) for deportation.
Imposes Harsher Penalties for Repeat Offenses
Establish that a second offense results in a felony charge, punishable by incarceration for 3-5 years. Upon completion of the sentence, the individual will be turned over to ICE for immediate deportation.
Collaborates with Federal Agencies
Authorize state and local law enforcement to work directly with ICE to ensure the timely removal of illegal aliens from West Virginia.
Allocates Resources for Enforcement
Provide resources for state and local law enforcement to effectively identify and detain individuals unlawfully residing in the state.
The safety of our families and communities must be our top priority. It is evident that the federal government’s failure to enforce immigration laws has left us vulnerable. It is time for West Virginia to step up and take action to protect its citizens by enforcing immigration laws at the state level.
This petition calls on our elected officials to act swiftly and decisively in passing legislation to make illegal presence a criminal offense under West Virginia state law, ensuring the safety and security of all West Virginians.
